1. Validity of the General Terms and Conditions

Our General Terms and Conditions (GTC) regulate the content of the purchase contract concluded between the customer and us for goods in our range. Our terms and conditions can be accessed on our website at any time. The terms and conditions published by us at the time the contract is concluded with the customer apply.

Unless the customer expressly agrees something else with us in writing, the content of the General Terms and Conditions forms the content of the concluded purchase contract.

We refer to our terms and conditions with every purchase of goods from our range. If the customer does not want to buy under these conditions, he has the option of not accepting the General Terms and Conditions. In this case, a contract does not come about.

2. Conclusion of contract

The customer's order in our web shop forms the offer for the conclusion of the contract. The customer is bound to his offer by a reasonable period of at least ten days. We confirm acceptance of the offer by email. The content of the concluded contract results from the content of the order confirmation and these conditions. There is no obligation to accept the offer.

The condition for the validity of the contract is that the ordered goods are available from us. All offers are valid while stocks last unless otherwise noted. Errors reserved. If the desired product is out of stock, we will contact the customer.

3. Legal capacity

The customer must have the legal capacity to act in accordance with the applicable legal provisions. If we have doubts about the customer's age, we are entitled to request a copy of an official photo ID to be sent.

4. Customer Data

After the customer has placed the desired items in the shopping cart, he clicks to go to the electronic registration and is prompted to provide the following data:

  • First name,

  • Last name,

  • Birth date,

  • E-mail address,

  • Password,

  • Bill address,

  • delivery address,

  • payment method.

In the case of payment by credit card (processed by PayPal), the customer will then be asked to enter the credit card details.

We are entitled to store and process the data in compliance with the provisions of the Data Protection Act. In addition, our data protection conditions apply.

If the customer does not expressly object to this, we will also use the e-mail address provided to keep the customer informed about our offers.

This consent can be revoked at any time by sending an email to gneiss@ecaffe.at.

5. Prices

Our products are announced in the online shop, stating the gross price of the goods, excluding packaging and shipping costs in euros. The prices stated at the time of the order apply, which are listed again in the order confirmation sent by us.

The packaging and transport costs are listed on our homepage at https://ecaffe.at/shop/versand. Before the customer confirms ordering the goods, the respective price for packaging and shipping will be listed separately and shown again in the order confirmation sent by us.

6. Payments 

Payments can be made using a valid credit card, PayPal account or prepayment to our account.

Payment by credit card is processed via PayPal. The terms and conditions of the service provider apply, which can be found underhttps://www.paypal.com/de/webapps/mpp/ua/legalhub-fullare available.

The purchase price is due for payment upon conclusion of the contract or receipt of the invoice (payment in advance). Once the payment has been made, we will ship the goods. Any bank charges are at the expense of the customer.

7. Delivery times & availability of goods

After payment has been made, we will arrange for the goods to be shipped immediately. The usual delivery time is four working days within Austria and eight working days within the EU. In exceptional cases, delivery times may be longer. Should this be more than two weeks, we will inform the customer as soon as possible. We accept no responsibility for delays that are not within our control. Any resulting claims against us are excluded.

Minimum purchase quantities result from our current price list.

If this is expressly requested by the customer, we can also deliver our goods as express transport for an additional charge.

If not all ordered products are in stock, the seller is entitled to make partial deliveries at his own expense, insofar as this is reasonable for the customer.

If the delivery attempt fails, the seller can withdraw from the contract. Any payments made will be reimbursed to the customer immediately.

If the ordered product is not available because the seller is not supplied with this product by his supplier through no fault of his own, the seller can withdraw from the contract. In this case, the seller will inform the customer immediately and, if necessary, propose the delivery of a comparable product. If no comparable product is available or the customer does not want a comparable product to be delivered, the seller will immediately reimburse the customer for any consideration already paid.

5.5. Customers are informed about delivery times and delivery restrictions (e.g. limitation of deliveries to certain countries) on the shop's homepage.

8. Transportation

In the name and on behalf of the customer, we will select and commission the most sensible mode of transport. When the goods are handed over to the carrier, the risk of loss and damage to the goods also passes to the customer.

If the customer is a consumer within the meaning of the Consumer Protection Act, the goods will be delivered at our risk.

9. Cancellation Policy 

The customer is entitled to withdraw from the concluded contract within 14 days of the invoice date without giving reasons. The revocation must be made by telephone (+43 (0) 699 170 827 39) or by e-mail (benefit@ecaffe.at). If the goods are already with the customer, the goods must be returned to us in their original packaging, undamaged and with submission of the invoice in return for a refund of the purchase price.

If the customer is a consumer within the meaning of the Consumer Protection Act, the cancellation period is 14 days from the day the goods were received by the customer. We will refund the purchase price. We also reimburse consumers for the transport costs.

10. Warranty & Liability 

We strive to deliver goods of impeccable quality to our customers. If products are defective, we must be informed immediately by telephone (+43 (0) 699 170 827 39) or by email (benefit@ecaffe.at). We will exchange the defective goods. We are entitled to request the customer to send the defective goods to us for inspection at our expense. If we cannot exchange the goods, we will replace the purchase price including shipping costs.

Optical deviations of the products shown in the online shop do not constitute a defect.

The commissioning and operation of the delivered coffee machines must be carried out in strict compliance with the instructions for use supplied with the goods. Claims for damage to the machine as a result of incorrect operation and maintenance, in particular due to a failure to descale the machine regularly, are excluded in any case.

If the customer is a consumer within the meaning of the Consumer Protection Act, the customer has the choice of requesting improvement, replacement of the goods, reasonable price reduction or conversion.

Warranty claims must be asserted within two years of delivery of the goods.

11. Damages

Insofar as products sold by us damage the customer due to errors, we assume liability if grossly negligent or intentional behavior on our part has led to the damage. Liability for consequential damages or lost profits is excluded. Otherwise, and especially if the customer is a consumer within the meaning of the Consumer Protection Act, the relevant laws apply.

12. Final Provisions

In the event of any problems, we try to find an out-of-court solution that is satisfactory for everyone. If this is not possible, the courts must decide. If we are forced to sue the customer, we will sue consumers within the meaning of the Austrian Consumer Protection Act at their place of residence, other customers at our company's registered office.

The court has to apply Austrian law, unless our customer is a consumer within the meaning of the Consumer Protection Act. In this case, the law applicable at his usual place of residence applies. The UN sales law is excluded.

Should one or more provisions of these General Terms and Conditions be or become invalid, the further provisions shall remain fully valid.
